DATA PROTECTION NOTICE
concerning personal data processed in relation to subscribers to the Newsletter of the Minority Ombudsman
The purpose of the following information notice is to help you, as a subscriber to the Newsletter of the Deputy Commissioner for the Protection of the Rights of Nationalities in Hungary (hereinafter referred to as the "Minority Ombudsman"), to find out all relevant information about the processing of your personal data.
Your data will be processed in accordance with Regulation (EU) No 2016/679 of the European Parliament and of the Council of 17 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Regulation (EC) No 95/46/EC (General Data Protection Regulation, hereinafter referred to as "GDPR") and Act CXII of 2011 on the Right to Informational Self-Determination and Freedom of Information (Freedom of Information Act).

5. Recipients of personal data
The data processed may only be known to the NBHT's executive officers and the staff responsible for the management of the Newsletter and will not be transmitted to any other parties.
6. Duration of data processing
The NBHT will process personal data until the purpose of the processing is fulfilled, but no later than until the consent is withdrawn or the data subject's data of public interest are deleted from the professional and protocol database.
7. Protection of data
The AJBH, and the NBHT as part of it, shall take all reasonable physical and logical protection measures to ensure the confidentiality, integrity and availability of the data it processes.
For the above purposes, AJBH and its constituent NBHT shall store the data it handles exclusively on servers at its own disposal, shall have a separate IT department and shall also have an IT Security and Operating Policy and a full access control mechanism.
8. Automated data processing, profiling
Decision-making based on automated data management does not take place at AJBH and NBHT.
9. Transfers to third countries or international organisations
No data will be transferred to third countries or international organisations.
10. Rights of the data subject in relation to data processing
10.1. Time limit
The NBHT shall comply with the data subject's request to exercise his/her rights within a maximum of one month from the date of receipt of the request. The date of receipt of the request shall not be included in the time limit. The NBHT may, if necessary, and taking into account the complexity of the request and the number of requests, extend this time limit by a further two months. The NBHT shall inform the person concerned of the extension of the time limit within one month of receipt of the request, stating the reasons for the delay.
10.2. Data subject's rights in relation to data processing
10.2.1. Right of access
The data subject has the right to obtain from the NBHT, through the contact details provided under point 2, information as to whether or not his or her personal data are being processed and, if such processing is ongoing, the right to be informed that
- which personal data;
- on what legal basis;
- for what purpose;
- for how long are processed by NBHT; and that
- to whom, when, under what law, to which personal data the NBHT has given access or to whom it has transferred personal data;
- the source of your personal data;
- whether the NBHT uses automated decision-making and its logic, including profiling.
The NBHT will provide a copy of the personal data that is the subject to data processing by the NBHT to the data subject free of charge upon request for the first time, and may charge a reasonable fee based on administrative costs thereafter.
In order to ensure data security and to protect the rights of the data subject, the NBHT is obliged to verify the identity of the data subject and of the person who wishes to exercise his or her right of access, and to this end, the provision of information, access to or copying of the data shall be subject to the identification of the data subject.
10.2.2 Right to rectification
The data subject may request the NBHT to correct inaccurate personal data relating to him or her through the contact details provided in section 2. Where the data subject can credibly demonstrate the accuracy of the corrected data, the NBHT will comply with the request within a maximum of one month and will notify the data subject thereof using the contact details provided by the data subject.
10.2.3 Right to blocking (restriction of processing)
The data subject may request, through the contact details provided under point 2, that the processing of his or her personal data be restricted by the NBHT (by clearly indicating the restriction of processing and ensuring that it is kept separate from other data) where
- the data subject contests the accuracy of his or her personal data (in which case the NBHT will limit the processing for the period for which it verifies the accuracy of the personal data); - the processing is unlawful and the data subject opposes the erasure of the data and requests instead that its use be restricted;
- the controller no longer needs the personal data for the purposes of the processing but the data subject requires them for the establishment, exercise or defence of legal claims;
- or the data subject has objected to the processing (in which case the restriction applies for a period of time until it is established whether the legitimate grounds of the controller override the legitimate grounds of the data subject).
10.2.4 Right to object
The data subject may object to the processing under point 4 at any time on grounds relating to his or her particular situation, using the contact details provided in point 2, if he or she considers that the NBHT is processing his or her personal data in a way that is incompatible with the purposes of this privacy notice. In such a case, the NBHT must demonstrate compelling legitimate grounds for processing the personal data which override the interests, rights and freedoms of the data subject or for the establishment, exercise or defence of legal claims.
10.2.5. Right to erasure
In relation to the processing described in the information notice, the data subject may exercise the right to erasure only if the data are no longer necessary for the performance of the tasks of public interest carried out in the exercise of official authority vested in the NBHT or for the performance of the tasks of public interest carried out by the NBHT. This right may therefore be exercised in relation to data processed for the purposes set out in the second case (voluntary consent) in point 4 of this notice.
11. Right to legal redress
If the data subject considers that NBHT has infringed the applicable data protection requirements in the processing of his/her personal data, he/she may:
A. file a complaint with the National Authority for Data Protection and Freedom of Information

B. have the possibility to lodge an appeal for the protection of his/her data with a court, which will decide on the matter out of turn. In this case, he is free to decide whether to bring his action before the court having jurisdiction for his domicile (permanent address) or residence (temporary address) or the court having jurisdiction for the seat of the Authority. The competent court for the place where the Authority is located is the Metropolitan Court of Budapest.
